The RAM janma bhoomi and Babri masjid controversy is no longer a subject of Courts to adjudicate upon.The Supreme Court of India has rightly stayed the delivery of High Court’s judgement on the matter.Hope the enterim stay gets regularised in the next hearing due on 28th Oct’2010.
It has been argued that efforts to make out-of-court settlement have failed.
In fact what’s needed is courrt mediated binding settlement.The Supreme Court could initiate mediation among the concerned parties and strike a settlement acceptable to all.ALL PARTIES ARE SAYING NOW THAT THEY WOULD RESPECT THE VERDICT OF THE hIGH cOURT.IN THE SAME REATH, THEY ALSO SAY THAT IF THEY LOSE HERE THEY WILL CERTAINLY APPEAL IN THE SUPREME COURT !!
What does it indicate? None of the parties would be satisfied with the ’semi-final’ !The matter will continue to drag longer with all the ugly
consequences and ill-will between the two communities !
Let the court mediated out-of -court settlement take some more time but the gesture of respect that all parties are showing towards the Supreme Court ssuggests that an amicable setlement may be reached.
The ‘give and take’ spirit can’t be trusted with political mediation but the same spirit could be acceptable if appropriate judicial mediation is done.
Let us empower the Supreme Court through a pARLIAMENTARY LEGISLATION IF SUCH POWERS ARE NOT ALREADY EXISTING !
