POWER OF ATTORNEY
My aim is to help, who are seeking information about medical and legal, many knows about power of attorney and their values, but my self feel that, its help some more persons.
Power of attorney is many types, and some of them provide sweeping powers to the Power Of Attorney Holder, while others only allow them to do specific things such as original power holder wants.
Now days, power of attorney using mostly NRI personals, Several NRI's wants to buy property in India soil, by granting a power of attorney to a resident citizen. In fact when NRIs invest in apartments or property many builders specifically suggest that they give them a power of attorney. This helps circumvent long delays arising out of legal and other documents being sent to NRI owners in a foreign country.
However, as with all solutions to a problem granting a sweeping power of attorney to a builder or to a relative can have drawbacks, such as making the NRI liable for all actions taken on his behalf by the POA holder, So essentially NRIs have two choices when buying property, either provide a power of attorney to someone or choose not to.
An important point to note is that, NRIs have to get the power of attorney drafted by a lawyer in the country they reside in as it cannot be drafted on Indian stamp paper. Additionally it has to be properly notarized by the correct authorities to have any validity in
Before even deciding to grant anyone a power of attorney, finding a trustworthy person is all important. If you are an NRI contemplating granting a power of attorney to a builder or a relation, providing a limited power of attorney for specific items is a good decision.
A well drafted power of attorney when gives to the right person can be a useful and powerful too, allowing NRIs to invest, buy property or simply plan for their future. A good attorney will not only provide you with a well drafted agreement but he will also be able to ensure that the power of attorney is not misused intentionally or unintentionally.
